Terms of Service

These Terms of Service (the "Terms") set out the conditions on which Individual Entrepreneur Eduard Zviagintsev (Georgia, Tbilisi, Krtsanisi District, Nino and Ilia Nakashidze Street, N1, (former Avlevi), area flat N3, building N3; the "Company") makes the Gooze service (the "Service") available to any individual (the "User").

By using the Service — including paying for a subscription — you agree to these Terms. If you do not agree, do not use the Service.

1. Subject matter

The Service gives the User access to a food diary with AI meal analysis, calorie and macronutrient counting, and weight tracking through a Telegram bot and Telegram Mini App.

The Service is informational and advisory in nature and does not constitute medical services, medical diagnosis, or the prescription of treatment. The Service's recommendations do not replace consultation with a physician or a certified dietitian. The User makes decisions about nutrition, diet, and physical activity independently and at their own risk; in the presence of any medical conditions or health limitations, the User must first consult a physician.

The Service is intended for individuals who are at least 18 years old and have full legal capacity. By using the Service, the User confirms that they meet this requirement.

2. Account and User obligations

The User is responsible for protecting their account from unauthorised access and must not disclose access credentials to third parties. The User is responsible for all actions performed through their account.

The User agrees not to use the Service to:

  • send spam or other unsolicited messages;
  • perform acts that violate applicable law or the rights of third parties;
  • upload materials of an illegal, harmful, or offensive nature;
  • interfere with the operation of the Service or attempt to gain unauthorised access to it.

3. Personal data

To provide the Service, the Company processes the User's personal data: the Telegram identifier, profile data, and information the User enters into the Service (nutrition logs, weight, and similar metrics).

By accepting these Terms, the User consents to the processing of such data solely for the purpose of operating the Service and in accordance with applicable data-protection legislation. The procedure for processing and protecting personal data is set out in the Company's Privacy Policy.

4. Payment and subscription

The Service operates on a subscription model. On first use, the User receives a free trial period: 7 days of access to features without entering payment details.

Subscription payments are made through the payment provider shown at checkout. Current prices are shown in the pricing section of the application.

By purchasing a subscription, the User agrees to the storage of their payment details for automatic renewal. A few days before the end of the paid period, the Company automatically charges the amount for the next period to the saved payment method. The User may cancel auto-renewal at any time in the subscription section of the app; cancellation stops future charges while any already-paid access period remains active until it ends.

The Company may change its prices; price changes do not apply to a period that has already been paid for.

5. Refund terms

The User may request a refund if the Service cannot be used for technical reasons attributable to the Company, within 14 days of payment, by contacting support. A refund is issued after verification that the paid features were not used. The cost of the trial period is non-refundable.

Nothing in these Terms limits any rights the User may have under applicable consumer-protection legislation.

6. Limitations and liability

The Company makes reasonable efforts to keep the Service running without interruption, except during maintenance and repair work. The Service may be unavailable for reasons beyond the Company's control, including failures of third-party services — the AI meal analysis provider (Anthropic, Claude models) and the Telegram messenger.

The Company does not guarantee the accuracy, completeness, or fitness for a particular purpose of nutrition data computed using artificial intelligence, and is not liable for decisions the User makes based on such data.

The Company is not liable for the loss of data or messages caused by technical failures. The Company's liability is limited to the extent permitted by applicable law.

7. Consequences of violations

Hacking, distribution of malware, fraud, phishing, and other User actions deemed illegal or made in bad faith may result in the suspension or complete termination of the Service.

8. Changes

The Company may amend these Terms. A new version takes effect upon its publication in the Service. Continued use of the Service after the changes are published constitutes the User's acceptance of the new version; if the User does not agree, they must stop using the Service.

9. Governing law and dispute resolution

These Terms are governed by the law of Georgia. Disputes are resolved through negotiation; a claim may be sent to the Company's email address and will be reviewed within 30 days. If no agreement is reached, the dispute will be referred to the competent courts of Georgia.
